PeakFiber strives to honor the confidentiality of our customers. We want you to have confidence in your use of the internet. This privacy policy is designed to explain our commitment to your privacy and our monitoring activities.
The Personal Data we collect
We may collect, use, store and transfer different kinds of personal data about you. At time of registration, PeakFiber requests your name, address, telephone number, e-mail address, and either credit card or bank account information for recurring payments.
How do we collect your Personal Data
PeakFiber requests certain personal information at the time you register via phone or through our online forms. Additionally, we collect information about you through our residential service agreement forms, payment authorization forms, or otherwise information you provide directly to us via communications and responses to customers surveys. Cardholder and bank account information is only to be transmitted verbally over the phone, in person, through our customer portal, or securely through our electronic document systems. Additionally, PeakFiber collects, and processes information provided directly by you when you install the PeakFiberIQ App and register for an account to use the App. Specifically, this information includes:

Your name, email address, location, phone number.

Browser information and session cookies related to your access and use of the App.

Data insights PeakFiber attains based on correlation and analytics of your information collected in providing the App, which may be used in aggregated and dis-aggregated formats or to obtain trend analytics, to provide the App; and

Use of the above-described collected information in aggregated and dis-aggregated formats to enhance our current App or to provide App features.
How PeakFiber uses information we collect
PeakFiber uses the information collected as described in this Privacy Policy, including personal information, to:
• Manage your account for billing and service purposes.
• Provide you with the PeakFiberIQ App and all its functionality
• Implement, improve and/or enhance the App, including to make future releases available to you.
• Carry out PeakFiber obligations as described or authorized in the Residential Service Agreement and this Privacy Policy.
• Enforce PeakFiber rights arising from the Residential Service Agreement between you and PeakFiber; and
• Fulfill any other purpose authorized by you and reasonably required for the App.
Your information is not shared with a third party, except in very limited circumstances such as is required by law.
Customer Surveys
From time to time, PeakFiber may contact you as part of a customer survey. Participation in customer surveys is purely voluntary, but we welcome and
encourage you to respond to these surveys. Personal information gained in these responses will be held in confidence.
Right to Monitor Communications and Disclose Information
It is generally PeakFiber’s policy not to share personal information about you, however, PeakFiber has the right to monitor use of our service. PeakFiber may disclose personal information about you and/or your account at our sole discretion in order to comply with the Electronic Communications Privacy Act, the Digital Millennium Copyright Act, the Patriot Act or any other laws, to enforce our Acceptable Use Policy, to protect the integrity of PeakFiber’s operations, to protect our customers or to prevent a crime. You expressly grant PeakFiber permission to disclose personal information in response to: (a) a subpoena issued in a civil or criminal investigation or in litigation; (b) a civil investigative demand issued by a government entity; or (c) a court order. PeakFiber may disclose personally identifiable information to law enforcement agencies when expressly required to do so by law.
Collection and Use of Technical Information
When you use PeakFiber, and the PeakFiberIQ app, we gather technical data. We use the technical data to ensure reliable delivery, assess better ways to meet your Internet usage needs, and to assist in problem solving.
PeakFiberIQ App Deletion and Collected Data Deletion
For information about how you can delete the PeakFiberIQ App, and any data collected by it, simply contact us by calling 937-599-7220 and requesting Customer Service, or by e-mailing support@peakfiber.net.
Third Parties
Some third parties might acquire information about you when you use or visit their websites or utilize their services online through your PeakFiber connection. PeakFiber does not undertake to monitor, and may not be capable of monitoring, the collection, use or disclosure of such information.
Safeguarding Measures
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality. We will notify you and any applicable regulator of a breach in personal information where we are legally required to do so.
Protection of Children’s Privacy
PeakFiber wants to protect the privacy of children. Thus, PeakFiber does not collect any personal information from children under the age of 18.
Revisions to Privacy Policy
PeakFiber reserves the right to update or modify this Privacy Policy at any time. Notice of modifications to this Privacy Policy may be given by posting such changes to PeakFiber’s web site at www.peakfiber.net. This Policy was adopted 12/29/2021, with revisions on 3/10/2022, 8/20/24
